provided by DescribeMe, Inc., however we will refer to our company and Service
as “DescribeMe” “DescribeMe Network” or “DescribeMe Network Service” to maintain

/ or Responsibilities, do not register (sing up) an account with DescribeMe. By
Registering, accessing or using the DescribeMe Service, you agree to be bound by
these Principles, Rights and / or Responsibilities. These terms apply to all
visitors and registered users.
We are building DescribeMe as a
powerful world subconscious research tool. This with the purpose to make the
world more open and transparent, which we believe will create greater
understanding about yourself and others therefore increasing chance of
successful connections. DescribeMe promotes an anonymous way to users of
expressing themselves therefore encouraging honesty in each description about
others. Certain Principles guide
DescribeMe in pursuing these goals. Achieving these principles should be
constrained only by limitations of law, technology, and evolving social norms.
We therefore establish these Principles as the foundation of the rights and
responsibilities of those within the DescribeMe Service.
1. Freedom to express yourself about others
should have the freedom to share whatever perception they have about other
registered users by the 1-10 rating scale, 0 exists as a Not Applicable option.
Registered users may describe or be described by anyone - any person,
organization or service - as long as they both registered DescribeMe users and
have agreed to this Terms and Conditions. DescribeMe will not allow any
malicious slanderous descriptions or defamation of character to remain in a

control only certain parts of their information, such as Email, Location,
Telephone Number, Nickname and Employment. They have the freedom to change any
of these at any time. People will have the option to show their email, age,
telephone number and employment information to anyone who chooses see their

for them using the DescribeMe Network Service. Those controls, however, are not
capable of limiting how those who have received information may use it,
particularly outside the DescribeMe Network Service. People will not have the
freedom of removing the profile once it has been created, much less the
descriptions from others about them.
3. Free Flow of Information
People should have
the freedom to access all of the information made available to them by others
including descriptions received. People should also have practical tools that
make it easy, quick, and efficient to share and access the above mentioned
information (Principle Number 2).
4. Fundamental Equality

information within the DescribeMe Network Service, regardless of the Person's
primary activity. There should be a single set of principles, rights, and
responsibilities that should apply to all People using the DescribeMe Network

should be able to use DescribeMe for free to establish a presence, describe
others, be described by others and share information with them. Every Person
should be able to use the DescribeMe Service to search for information
regardless of his or her level of participation or contribution. Users that have
received more descriptions than the ones that they have actually given out, may
no longer be described by others unless they equate or surpass the current
amount of given descriptions.
7. Open Platforms and Standards
may at one point have programmatic interfaces for sharing and accessing the
information available to them. The specifications for these interfaces should be
published and made available and accessible to everyone.
8. Common Welfare
rights and responsibilities of DescribeMe and the People that use it should be
described in a Regionment of Rights and Responsibilities, which should not be
inconsistent with these Principles. This Regionment may be found in the next
section after the principles.
9. Transparent Process
DescribeMe should publicly make available information about its purpose, plans,
policies, and operations.
10. One World
Network Service should transcend geographic and national boundaries and be
available to everyone in the planet earth and others shall there be any contact.

This agreement was
written in English (US). To the extent any translated version of this agreement
conflicts with the English version, the English version controls. Please
note that a section 13 contains certain changes to the general terms for users
outside the United Regions.

This Regionment of
Rights and Responsibilities ("Regionment," "Terms," or "SRR") derives from the
DescribeMe’s Principles, and is our terms of service that governs our
relationship with users and others who interact with DescribeMe. By using or
accessing DescribeMe, you agree to this Regionment, as updated from time to time
in accordance with Section 10
below. Additionally, you may find resources once you have created an account
that may help you understand how DescribeMe works.
A. Privacy of some information you provided when you registered is very important
to us. Please refer to Principle #2 to get the details of what exactly you may
control once you have signed up. It is encouraged to read the Principle #2 and use it to
help you make informed decisions before you register. All your descriptions (how
people perceive you) are made available to the public as soon as they are given
by other users. You understand that by using our service you are
consenting to the collection, use and disclosure of your personally identifiable
information. While we work really hard to protect the security of your content
and account, DescribeMe cannot guarantee that unauthorized third parties will
not be able to defeat our security measures. You acknowledge that you are
providing your information at your own risk.
2. Sharing Your
Content, Information and Perceptions
DescribeMe owns all the content and information you post on DescribeMe, you may
control the privacy settings for some of the some information you provided when
you registered. In Addition:
A. For content that is covered by intellectual property rights, like photos (IP
content), you specifically give DescribeMe the following permission: you grant
us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide
license to use any IP content that you post on or in connection with DescribeMe
(IP License). This IP License does not end. Your content will be shared therefor
you are allowing everyone, including people off of DescribeMe, to access and use
that information, and to associate your profile content with you (i.e., your
name and profile picture). Your Regiond
descriptions will be kept private for the described users to ensure anonymity.
Your Account does keep a record of your descriptions of others in case
you may need to refer to them at any point.
B. When you delete IP content, it is deleted in a manner similar to emptying the
recycle bin on a computer. However, you understand that removed content may
persist in backup copies for a reasonable period of time (but will not be
available to others).
C. We always appreciate your feedback or other suggestions about DescribeMe, but
you understand that we may use them without any obligation to compensate you for
them (just as you have no obligation to offer them).
D. Each description given to a specific user by you will be recorded, you need to
sign it by a triggering a safety feature that enables users to finish the
description process. Once you agree that have truthfully described how you
perceive that person at that point in time, this checkbox or textbox with your

D. You may contact

that you consider defamation of character.
a. Defamation: Any intentional false communication,
either written or spoken, that harms a person's reputation; decreases the
respect, regard, or confidence in which a person is held; or induces
disparaging, hostile, or disagreeable opinions or feelings against a person.
Defamation may be a criminal or civil charge. It encompasses both written
Regionments, known as libel, and spoken Regionments, called slander.
DescribeMe administration takes the Defamation of character extremely serious,
DescribeMe will not be used exclusively to damage one or more people’s
reputation. If an abnormality is reported, the descriptions in a reasonable and
/ or specified by the users date range will be analyzed and its origin will be
traced and determined. If the descriptions come from an account that is
considered by the administration as false/fake/bot or misleading, the
description will be removed in order to adjust and reflect the real score. If
the description comes from an account with a reasonable length of establishment
and regular use pattern, that means the description does in fact reflect the
persons opinion and will remain in the described person’s record unless the
person that Regiond the description decides to change it after the one (1) week
period of time which forbids users to change an specific given description.
DescribeMe is intended to reflect reality, do not expect all 10’s or all 1’s
nobody is that good nobody is that bad of a person.
E. You will not use our copyrights or trademarks (including DescribeMe Inc.,
DescribeMe, DescribeMe Network, DescribeMe.Net, D Logos, DM, Describe,
Descriptive Seal, Adjective ticker), or any confusingly similar marks.
F. If you collect
information from users, you will: make it clear you (and not DescribeMe) are the
information you collect and how you will use it.
G. You will not post anyone's identification documents or sensitive financial
information on DescribeMe.
6. Mobile and Other Devices
A. We will provide our mobile services for free, but please be aware that your
carrier's normal rates and fees, such as text messaging fees, will still apply.
B. In the event you change or deactivate your mobile telephone number, you will
update your account information on DescribeMe within 48 hours to ensure that
your messages are not sent to the person who acquires your old number.
C. You provide consent and all rights necessary to enable users to sync (including
through an application) their devices with any information that is visible to
them on DescribeMe.
7. About Advertisements
and Other Commercial Content Served or Enhanced by DescribeMe
Our goal is to deliver ads and commercial content that are valuable to our users
and advertisers. In order to help us do that, you agree to the following:
A. You may not limit how your name and profile picture may be associated with
commercial, sponsored, or related content (such as a brand you like) served or
enhanced by us. You give us permission to use your name and profile picture in
connection with that content, subject to the limits you place. Or in connection
to DescribeMe’s own advertising within the website.
8. Special Provisions
Applicable to Advertisers
A. You can target your desired audience by buying ads on DescribeMe. The terms and
conditions such as order placing, campaign information and details, positioning

A. If you download our software, such as a stand-alone software product or a
browser plugin, you agree that from time to time, the software may download
upgrades, updates and additional features from us in order to improve enhance

to extract source code from us, unless you are expressly permitted to do so
under an open source license or we give you express written permission.

prior notice to any user in our outside DescribeMe’s Network. The only core
fundamental value that will remain is the defamation of character prohibition
enforcement. No slandering will be permitted or supported.
B. When you sign up for DescribeMe, you will also be asked to choose a
password. You are entirely responsible for maintaining the confidentiality of
your password. You agree not to use the account, username, email address or
password of another Member at any time or to disclose your password to any third
party. You agree to notify DescribeMe immediately if you suspect any
unauthorized use of your account or access to your password. You are solely
responsible for any and all use of your account.
C. You are fully responsible for your use of the services, and for any

evolving and nature of services that DescribeMe provides may change from time to
time without previous notice to you. Additionally, DescribeMe may stop
(permanently or temporarily) providing the Services (or any features within the
Services) to you or to users generally and may not be able to provide you with

D. We can make changes for legal or administrative reasons, or to correct an

Florida will govern this Regionment, as well as any claim that might arise
between you and us, without regard to conflict of law provisions. You agree to
submit to the personal jurisdiction of the courts located in Miami-Dade County,
Florida for the purpose of litigating all such claims.
B. If anyone brings a claim against us related to your actions, content or
information on DescribeMe, you will indemnify and hold us harmless from and
against all damages, losses, and expenses of any kind (including reasonable
legal fees and costs) related to such claim. Although we provide rules for user
conduct, we do not control or direct users' actions on DescribeMe and are not
responsible for the content, information or perceptions express in descriptions
that users transmit or share on DescribeMe. We are not responsible for any
offensive, inappropriate, obscene, unlawful or otherwise objectionable content
or information you may encounter on DescribeMe. We are not responsible for the
conduct, whether online or offline, or any user of DescribeMe users. DescribeMe
is a medium that allows people to express themselves about others without any
comments, encourages honesty and freedom of opinion.
C. WE TRY TO KEEP DESCRIBEME UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN
RISK. WE ARE PROVIDING DESCRIBEME AS IS WITHOUT ANY EXPRESS OR IMPLIED
WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT
DESCRIBEME WILL ALWAYS BE SAFE, SECURE OR ERROR-FREE OR THAT DESCRIBEME WILL
ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS OR IMPERFECTIONS. DESCRIBEME IS NOT
RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, PERCEPTIONS EXPRESSED AS
NUMBERS IN DESCRIPTIONS OF OTHER USERS OR DATA OF THIRD PARTIES, AND YOU RELEASE
US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES,
KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU
HAVE AGAINST ANY SUCH THIRD PARTIES. WE WILL NOT BE LIABLE TO YOU FOR ANY LOST
PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING
OUT OF OR IN CONNECTION WITH THIS RegionMENT OR DESCRIBEME, EVEN IF WE HAVE BEEN
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT
OF THIS RegionMENT OR DESCRIBEME WILL NOT EXCEED THE GREATER OF ONE HUNDRED
DOLLARS ($100). APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF
LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR
EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, DESCRIBEME'S LIABILITY WILL BE
LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
13. Special Provisions Applicable to Users Outside the United Regions
We strive to create a global community with consistent standards for everyone,
but we also strive to respect local laws. The following provisions apply to
users and non-users who interact with DescribeMe outside the United Regions:
A. You consent to having your personal data and given or/and received descriptions
transferred to and processed in the United Regions.
By “DescribeMe”, “DescribeMe Network”, “DescribeMe Network Services”,
“DescribeMe.Net”, “DescribeMe Inc.” we mean the features and services we make
available including through (a) our website describeme.net and any other
DescribeMe branded or co-branded products or websites (including sub-domains,
international versions, widgets, and mobile versions); (b) our Platform; Our social plugins if
any are ever offered.
B. By description we mean a rate from 1 to 10 (or 0 (zero) for Not Applicable)
in the categories and subcategories offered to the users.
C. By described we mean the user that received a description from any other
D. By "Platform" we mean
a set of APIs and services (such as content) that enable others, including
application developers and website operators, to retrieve data from DescribeMe
or provide data to us.
E. By "information" we
mean facts and other information about you, including actions taken by users and
non-users who interact with DescribeMe.
F. By "content" we mean
anything you or other users post on DescribeMe that would not be included in the
definition of information.
G. By "use" we mean use,
copy, publicly perform or display, distribute, modify, translate, and create
derivative works of.
H. By "application" we
mean any application or website that uses or accesses Platform, as well as
anything else that receives or has received data from us. If you no longer
access Platform but have not deleted all data from us, the term application will
apply until you delete the data.
A. If any portion of this Regionment is found to be unenforceable, the remaining
portion will remain in full force and effect.
B. If we fail to enforce any of this Regionment, it will not be considered a waiver.
C. Any amendment to or waiver of this Regionment must be made in writing and signed
D. You will not transfer any of your rights or obligations under this Regionment to
anyone else without our consent.
E. All of our rights and obligations under this Regionment are freely assignable by
us in connection with a merger, acquisition, or sale of assets, or by operation
of law or otherwise.

H. You will comply with all applicable laws when using, accessing DescribeMe or
describing others with the available tools.
I. Beta testers registered
prior to August 25th 2012 (Official production describeme.net launch
date) will have the option to delete their profile if desired at any point in
time without prior questions asked.
